BSA/POLARIS HELMET HAIR PHOTO CONTEST
OFFICIAL RULES
Many Will Enter; Four (4) Will Win the Grand Prize. Entrants Under the Age of 18 Must Obtain Parent or Legal Guardian’s Permission Before Entering.
1. Eligibility: The BSA/Polaris ATV Helmet Safety Contest is open only to legal residents of the 50 United States and the District of Columbia, ages 14-21 years of age. Employees, contractors, directors and officers of Boy Scouts of America (“Sponsor”) and its affiliated companies, as well as those of Sponsor’s distributors, licensees, advertisers, agencies, and prize providers involved in the development and administration of this Promotion (collectively, “Promotion Parties”), and their immediate family members (parent, child, sibling and spouse of each) and those living in the same households of each are not eligible. VOID ELSEWHERE AND WHERE PROHIBITED BY LAW.
2. Promotion Period: The Promotion begins at midnight Central Daylight Time (“CDT”), May 20, 2023, and ends 11:59:59 p.m. Central Daylight Time (“CDT”), August 31, 2023 (the “Promotion Period”).
3. How to Enter: Enter for your chance to win by submitting a photo of yourself with messy or wild helmet hair. Take a creative photo of yourself (the “Entrant”) with wild or messy helmet hair to show us how you protect your head not your hair then either (1) visit the contest landing page at go.scoutlife.org/Polaris and use the submission form there to enter your name, email address, and upload your photo, or (2) post your photo to your Instagram account with the hashtag #HelmetHairDontCare (each entered photo is referred to herein as the “Entry”). Alternatively, you can enter by taking a safety quiz at go.scoutlife.org/Polaris. LIMIT ONE ENTRY PER PERSON. Entrants under the age of 18 years old must have his or her parent or legal guardian’s permission to enter in order to be eligible to win. If an entrant chooses to enter via wireless device, he or she may be charged data rates according to the terms of his or her service agreement with the wireless carriers. Each wireless carrier’s rate plan may vary, and entrants should contact their wireless carrier for information on rate plans and charges relating to their participation in this Promotion.
4. Entry Requirements: In order to be eligible, an Entry must comply with these Official Rules, must show only BSA-approved safety equipment, and must not: (a) contain obscene, profane, lewd, or defamatory material; (b) infringe or misappropriate any copyright, trademark, patent, trade secret, publicity rights, or privacy rights of any other person or business; (c) promote alcohol, illegal drugs, depict gambling references or tobacco use, firearms/weapons (or the use of any of the foregoing), any activities that may appear unsafe or dangerous, or any particular political agenda or message; (d) contain material that does not reflect the Sponsor’s values or may damage Sponsor’s highly-regarded reputation, as determined by Sponsor in its sole discretion, (e) defame, misrepresent, or contain disparaging remarks about Sponsor or its products or other people, products, or companies; or (e) contain any other material that Sponsor, its sole discretion, deems objectionable. By entering this Promotion, each Entrant promises that: (1) his/her Entry is entirely original and the Entrant owns all rights in the Entry and have the right to grant Sponsor a license to use the Entry (including any material embodied in the Entry); and (2) all of the persons depicted in the Entry photo, if any, agree to the use of their image and likeness in the Entry photo and to Sponsor’s and/or its prize providers’ display of their image and likeness in connection with this Promotion. Entrants acknowledge and agree Sponsor has the right to display, perform, distribute, edit, adapt, modify, reproduce, promote and otherwise use any and all Entries in any manner it sees fit, and the right to sublicense the foregoing rights to third parties of Sponsor’s choice, including but not limited to this Promotion’s prize provider(s). Any Entry not in compliance with these Official Rules or not meeting Sponsor’s requirements will be disqualified.
Safety : Photos may not be taken from an ATV, bike, skateboard, or other motorized or wheels operated vehicle that is operational and moving. Photos may not be taken by a Scout or leader operating an ATV, bike, skateboard, or other motorized or wheels operated vehicle. 5. Winners: Within 10 business days after the Promotion Period ends, a panel of judges designated by the Sponsor will select four (4) grand prize winners from among all eligible Entries. Judging will be based on the creativity of each Entry, including visual composition of the photo, and the extent to which the photo accurately and positively reflects the BSA’s ATV and helmet safety rules and guidelines. In the event that a potential Winner cannot be contacted, the email is undeliverable, the email address is incorrect, or any information requested from the potential Winner is not received by Sponsor within the specified time period, then potential Winner will be disqualified, and an alternate Winning may be selected at the sole discretion of the Sponsor.
6. Prizes & Odds: Each grand-prize winner will receive one (1) prize package containing a bag, goggles, helmet and gloves. Actual prizes may be a different model than shown in promotional material. The approximate retail value (ARV) of each grand-prize package is $227.96. No substitutions or cash equivalent of the Polaris ATV safety gear will be provided, except as the sole discretion of the Sponsor. Taxes, and all other expenses not specified herein, if any, are the responsibility of the winner. The winner is advised to consult with his/her tax advisors, lawyers, and/or financial advisors regarding the tax implications of the above-stated prizes. Prizes are awarded “as is” with no warranty or guarantee, either expressed or implied by Sponsor. The odds of winning depend on the number of total Entries received and the extent to which an Entry meets the judging criteria.
7. Privacy information: Winners’ names and addresses will be shared with the Promotion’s prize provider, Polaris Industries, Inc., for the sole purpose of prize fulfillment (Polaris will ship the prizes directly to the verified winners). Information collected by Sponsor from non-winning Entrants through this Promotion will be destroyed at the conclusion of the Promotion.
8. General: Winners under the age of 18 years old are required to have their parent or legal guardian sign and submit an affidavit of eligibility and parental consent form and release of liability and a publicity release within 10 days of attempted delivery (sent via email to potential Winners). This Promotion is not sponsored or administered by Facebook, Instagram, Twitter, or any other social media platform through which the Promotion may be advertised (collectively, “Social Media Platforms”). By participating in this Promotion, Entrants agree to release, discharge and hold harmless the Promotion Parties, all prize providers, and all Social Media Platforms from and against any and all claims, liabilities, and damages associated with this Promotion, including bodily injury and property damage resulting from Entrants’ participation in the Promotion, or the acceptance, use or misuse of any prize received in this Promotion. Promotion Parties are not responsible for any typographical or other error in the printing of the offer or administration of the Promotion. By participating in this Promotion, participants agree to be bound by the Official Rules and decisions of the Sponsor, which shall be final in all matters relating to the Promotion. Promotion Parties are not responsible for Entries that are lost, late, misdirected, stolen, illegible, inaccurate, damaged, incomplete, non-delivered or postage-due mail; or for printing, distribution or production errors or for technical, hardware, software, or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in this Promotion, or by any human, or other error, which may occur in this Promotion. If, in the Sponsor’s opinion, there is any suspected or actual evidence of tampering with any portion of the Promotion, or if technical difficulties compromise the integrity of the Promotion, the Sponsor reserves the right to disqualify suspect entries and/or modify or terminate the Promotion in a manner deemed reasonable by the Sponsor, in its sole discretion. In the event of a dispute regarding the identity of the person submitting an entry, entries will be declared made by the person’s name submitted at time of entry. Sponsor reserves the right to disqualify any individual who tampers with the Promotion or the Sponsor’s website or acts in a disruptive manner. The use of any automated, script, macro or robotic launching or entry software or any other mechanical or electronic means that permits the entrant to automatically enter repeatedly is prohibited. Any Entry found or suspected to be submitted in this manner will be deemed ‘void’ by the Sponsor. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS. IF SUCH AN ATTEMPT IS MADE, THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Governing Law and Jurisdiction: This Promotion is subject to all applicable federal, state and local laws and regulations. Void where prohibited. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of entrants and Sponsor in connection with this Promotion, shall be governed by, and construed in accordance with, the laws of the State of Texas, U.S.A., without giving effect to the conflict of laws rules thereof, and any matters or proceedings which are not subject to arbitration as set forth in the following paragraph of these Official Rules and/or for entering any judgment on an arbitration award, shall take place in the State of Texas, Dallas County.
Entrants and Sponsor waive all rights to a jury trial in any action or proceeding instituted in connection with these Official Rules and/or this Promotion. Any controversy or claim arising out of or relating to these Official Rules and/or this Promotion shall be settled by binding arbitration in accordance with the with the commercial arbitration rules of the American Arbitration Association. Any such controversy or claim shall be arbitrated on an individual basis, and shall not be consolidated in any arbitration with any claim or controversy of any other party. The arbitration shall be conducted in the State of Texas, Dallas County and judgment on the arbitration award may be entered into any court having jurisdiction thereof.
10. Promotion Errors: Promotion Parties assume no liability and are not responsible for, and you hereby forever waive any rights to any claim in connection with, errors and/or ambiguity: (a) in the Promotion; (b) in any related advertising or promotion of this Promotion; and/or (c) in these Official Rules. In the event of any ambiguity(s) or error(s) in these Official Rules, Sponsor reserves the right to modify these Official Rules for clarification purposes or to correct any such ambiguity or error(s) without materially affecting the terms and conditions of the Promotion.
11. Waiver: IN NO EVENT WILL THE PROMOTION PARTIES BE RESPONSIBLE OR LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING DIRECT, INDIRECT, INCIDENTAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING OUT OF YOUR ACCESS TO AND PARTICIPATION IN THE PROMOTION OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM THE PROMOTION. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. CHECK YOUR LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.
